This Privacy Policy describes what information Razzoo’s, Inc. and its affiliates (collectively, “Razzoo’s,” “us,” “our,” and “we”) collect about you, how we collect it, how we use it, with whom we may share it, and the choices you have concerning the use of such information. This Privacy Policy applies to your use of our website, our mobile website, , and any other platforms that link to this Privacy Policy (collectively, the “Site”) and any other means by which we may collect information about you, including information you may provide to us onsite at one of our restaurants. Please read this Privacy Policy carefully. Except as we disclose in this Privacy Policy, we will not sell, share, license, trade, or rent your personally identifiable information to others.
This Privacy Policy DOES NOT apply to information that:
(1) You provide to other Razzoo’s applications or websites, including websites you may access through our Site.
(2) You provide to or is collected by any third party.
(3) You provide or share in any public forum.
By accessing and using the Site, you agree that you have read and understand this Privacy Policy and that you accept and consent to the privacy practices (and any uses and disclosures of information about you) that are described in this Privacy Policy. We may amend this Privacy Policy at any time by posting any changes to this Privacy Policy here so that you will always know what information we gather, how we might use that information, and whether we will disclose that information to anyone. Your continued use of the Site after we make changes is deemed to be acceptance of those changes, so please refer back to this Privacy Policy periodically for updates.
1. The Types of Information Razzoo’s Collects. Razzoo’s collects personal information from you in the following ways:
(a) Personal Information You Provide to Us. For example:
(i) First and last name, address, email, phone number (ii) When you order menu items from the Site, we will collect all information necessary to complete the transaction. Razzoo’s may store this information on our servers, in order to make it easier for you to place orders in the future. We do not store your payment information on our servers. If you make a purchase through our Site, our third-party payment processor service providers may also collect billing information, such as your first and last name, email address, phone number, credit card or debit card number, and billing addresses. (vi) Demographic information
(vii) Dining preferences: Who you typically dine with (e.g., family, friends). When you normally visit our restaurant locations, How often you visit our restaurant location.
(viii) If you provide feedback or contact us via email, we will collect any content included in the email in order to send you a reply.
(b) Personal Information Collected Via Technology. We and our third-party service providers automatically collect information when you access and use the Site as described below:
(i) Information Collected by our Servers. Razzoo’s servers (which may be hosted by a third-party service provider) collect information from you, including the referring/exit pages, your browser type, clickstream data, pages visited on the Site, domain name, location, whether you access our Site from multiple devices, date/time stamp for your visit and your Internet Protocol (IP) address (a number that is automatically assigned to your computer or device when you use the Internet). Razzoo’s uses this information to analyze trends, administer the Site, monitor for fraudulent activities using fraud management tools, and better tailor the Site and services to users’ needs.
(ii) Cookies. Razzoo’s uses cookies to collect information on the Site. “Cookies” are small pieces of information that a web site sends to your computer’s hard drive while you are viewing a web site. Razzoo’s may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on the Site.
(iii) Web Beacons. Pages of the Site and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Razzoo’s, for example, to count users who have visited those pages or opened an email and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity).
(iv) Third-Party Analytics. We uses third-party service providers such as Google Analytics to help analyze how users use our services (“Analytics Companies”). These Analytics Companies use cookies and other tracking technologies to collect information such as how often users visit the Site, what pages they visit and for how long, what other sites they used prior to coming to the Site, and other engagement data. We use the information we get from these Analytics Companies to evaluate and improve the Site and services we provide. If you submit personal information on behalf of someone else, you must ensure and certify that you have their authorization and consent to provide us with their personal information.
2. Disclosure of Personally Identifiable Information. We will only disclose your personally identifiable information to other organizations, companies, and individuals as described in this Privacy Policy or as specifically agreed to by you. We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction.
(a) Service Providers. Razzoo’s occasionally engages third-party contractors and agents that provide services to Razzoo’s, such as credit card processing, marketing, database hosting, web analytics, and customer service. These entities may have access to personal information in order to perform their functions. We do not authorize them to use the information we share with them for any other purpose. We require that these contractors (i) protect the privacy of your personal information consistent with this Privacy Policy, and (ii) not use or disclose your personal information for any purpose other than providing us with products or services for which we contracted. We may also disclose aggregated, de-identified information, and analyses and reports derived from such information, to service providers, advertisers, merchants, consumer and market research companies, and other organizations. These service providers are responsible for their own compliance with data protection laws. (b) Laws and Legal Rights. We may also disclose your information if we believe in good faith that we are required to do so in order to comply with an applicable statute, regulation, rule or law, a subpoena, a search warrant, a court or regulatory order, or other valid legal process. We may disclose your personal information when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, in connection with an investigation of a complaint, security threat, or suspected or actual illegal activity, and in connection with an internal audit. © Affiliated Entities. We may disclose personal information that we collect or you provide to our subsidiaries and affiliates. No personal information or phone numbers collected through the Razzoo’s SMS program will be shared with Third Parties. (d) Change of Ownership or Organizational Structure. We may transfer personal information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Razzoo’s about our users is among the assets transferred. (e) Other Purposes. We may disclose personal information for any other purpose disclosed by us when you provide the information.
3. Use of Your Personal Information.
(a) General Use. In general, Razzoo’s uses your personal information to respond to your requests as submitted, to provide you the services you request, or to help serve you better. The precise purposes for which your personal information is processed will be determined by the request, and by applicable laws, regulatory guidance, and professional standards. Razzoo’s uses your personal information in the following ways:
(i) to provide services to you.
(ii) to provide our Site and its functionalities to you.
(iii) to provide you with location-specific services. If you elect to share your location information with us, we may use that information to tailor options, functionality, or offers related to your location.
(iv) to market our own services to you. If you join our rewards programs and other special marketing campaigns, we may use your personal information, including demographic information, birthday, personal preferences, purchase history, locations you visit, and information about you from third-party sources, including your location information, online browsing across time and third-party sites to send you real-time, geographically relevant and personalized offers, surveys, services, and promotions for our brands, affiliates, or third-party partners.

(vi) manage our business needs, such as monitoring, analyzing, and improving the services and the Site’s performance and functionality.

(b) Creation of Non-Identifiable Data. Razzoo’s may create de-identified information records from personal information by excluding certain information (such as your name) that makes the information personally identifiable to you. Razzoo’s may use this information in a form that does not personally identify you to analyze request patterns and usage patterns to enhance Razzoo’s products and services. Razzoo’s reserves the right to use and disclose non-identifiable information to third parties in its discretion.
4. Choices about Collection, Use, and Disclosure of Your Information. We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of over your information.
(a) Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Site may then be inaccessible or not function properly. Disabling or clearing cookies also may affect cookie-based opt-outs by either preventing you from using such cookie-based opt-outs or clearing opt-outs that you previously set.
(b) Profile. If you have created a profile or account on our Site, you can update your contact information after you log into your account.

If you have signed up to receive our promotional or informational email communications, you can unsubscribe any time by following the instructions for unsubscribing in the promotional or informational emails we send you. (d) Text Messages. If you have opted into a promotional text-based campaign, and no longer wish to receive SMS messages from us, you may opt-out from receiving future SMS messages from us by contacting us at the email address or phone number below. If you no longer wish to receive other SMS messages from us, you may opt-out from receiving future SMS messages from us by following the instructions for unsubscribing in the texts we send you or by contacting us at the email address or phone number below. Please note that even if you opt-out of receiving future marketing communications from us, we may still contact you about your account or any products or services you have purchased from us, and we will still respond to your inquiries or requests for information.
(e) Location Information. You can choose whether or not to allow us to collect and use real-time information about your device’s location through the device’s privacy settings. If you block the use of location information, some parts of the Site may become inaccessible or not function properly.

5. Marketing and Analytics. Razzoo’s and its third-party service providers may use the information you provide to us from your restaurant and online visits to conduct analytics to help us better understand our customers and improve our services, as well as to make you personalized offers of Razzoo’s or third-party products and services on our Site, in our restaurant locations or on third-party sites and services, and to feature personalized experiences at our Site and restaurant locations. Razzoo’s endeavors in good faith to adhere to self-regulatory advertising principles, such as the Digital Advertising Alliance’s Principles. If you are interested in learning more about and/or opting out of online behavioral advertising, sometimes called interest-based advertising, we encourage you to visit one of the advertising industry-developed opt-out pages, such as www.youradchoices.com or aboutads.info. Please note that while we provide these links for your convenience, we do not have access to, or control over, these third parties’ use of cookies or other tracking technologies.
6. International Data Transfers. If you are a non-United States user of the Site or services provided by Razzoo’s, by using the Site and providing us with data, you acknowledge and agree that your personal information may be processed outside the country in which it was collected, including the United States, where laws regarding processing of personal information may be less stringent than the laws in your country. By providing your data, you acknowledge such transfer.
The Site is hosted and operated in the United States. However, we and our service providers may store information about individuals in the United States, or we may transfer it to, and store it within, other countries.
Visitors from jurisdictions outside the United States visit us at their own choice and risk.
7. California Privacy Rights. If you are a California resident, the California Consumer Privacy Act of 2018 (the “CCPA”) may provide you with additional rights regarding our use of your personal information. Pursuant to the CCPA, effective January 1, 2020, consumers have certain rights, including:

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
(a) Deny you goods or services.
(b) Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

A business does not have to delete information if it is necessary to: (i) complete a transaction; (ii) prevent illegal activity; (iii) exercise free speech; (iv) comply with a legal obligation; (v) identify or repair errors that impair functionality; or (vi) otherwise use a consumer’s personal information, internally, that is compatible with the context in which the consumer provided that information.
8. Data Security. We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
Only authorized individuals access your personal information, and they receive training about the importance of protecting personal information. We strive to protect your personal information against unauthorized access, use or disclosure, using security technologies and procedures, such as encryption and limited access. We are not responsible for circumvention of any privacy settings or security measures we provide.
9. Persons Under the Age of 13. The Site is not intended for persons under 13 years of age. No one under age 13 may provide any information to or on the Site. We do not knowingly collect personal information from anyone under 13. If you are under 13, do not use or provide any information on the Site or through any of its features, make any purchases through the Site, or provide any information about yourself to us, including your name, address, phone number, or email address.
